Terms of Service

These Terms of Service govern your use of zeltmannnotary.com and any notarial services you engage from Zeltmann Notary Services (a DBA of Ralian LLC). By using this site or hiring us, you agree to these terms.

1. Notarial services, not legal services

Zeltmann Notary is a Texas Notary Public and a NNA Certified Loan Signing Agent. A notary public verifies the identity of the signer and witnesses the signing of documents. A notary public is not an attorney and does not give legal advice, draft legal documents, or represent any party. If you need legal advice, please consult a licensed Texas attorney.

2. §406.017 disclaimer

I am not an attorney licensed to practice law in Texas, and I may not give legal advice or accept fees for legal advice. (Texas Government Code §406.017). No soy un abogado licenciado para ejercer la abogacía en Texas y no puedo dar consejos legales ni aceptar honorarios por consejos legales.

3. Identification and refusals

Texas law requires every signer to present a valid government-issued photo ID, or to be identified by a credible witness who personally knows the signer and who is themselves identified by the notary. We will refuse to notarize if (a) the signer is not present, (b) the ID is invalid, missing, or does not match the signer, (c) the signer does not appear to understand the document or appears to be under duress or impairment, (d) the document is incomplete or contains blanks the signer has not filled in, or (e) the act would violate Texas law.

4. Fees

Per-act notarial fees are limited by Texas Government Code §406.024. Travel, after-hours, rush, printing, and other surcharges are quoted up front before the appointment and are not part of the statutory notarial fee. A trip fee is owed in full for any signing where we travel to the location, even if the signing is canceled at the table or the signer fails to appear (no-show).

5. Cancellation, no-show, and rescheduling

You may cancel or reschedule a signing free of charge up to 2 hours before the scheduled time. Inside 2 hours, a cancellation fee equal to 50% of the agreed fee applies. A no-show or refused signing at the table is billed at 100% of the agreed travel fee plus 50% of the signing fee. Title companies operating under a master services agreement are billed per the agreement instead.

6. Payment

Payment is due at the time of service unless otherwise agreed in writing. We accept cash, Zelle, Venmo, ACH, and major credit cards. Title companies and other recurring clients may be invoiced net-15. Past-due balances accrue 1.5% interest per month, or the maximum allowed by Texas law, whichever is lower.

7. Confidentiality

We treat the contents of every document as confidential. We do not retain copies of notarized documents beyond what Texas law requires us to keep in the notary journal.

8. Limitation of liability

Our total liability for any claim arising out of or related to a notarial act is limited to the lesser of (a) the fees paid for that specific act, or (b) the proceeds available under our $25,000 Errors & Omissions insurance and $10,000 Texas Surety Bond. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for the legal effect, validity, or enforceability of any document we notarize.

9. Independent contractor

When engaged by a title company, lender, signing service, or escrow officer, we act as an independent contractor and not as an employee, partner, or agent of that company.

10. Governing law and venue

These terms are governed by the laws of the State of Texas. Exclusive venue for any dispute is the state or federal courts located in Fort Bend County, Texas.

11. Changes

We may update these Terms of Service. The updated version will appear on this page with a new "Last updated" date.
